These Terms and Conditions apply when you browse this website or order products from Gustamo. By placing an order, you confirm that you are at least 18 years old, are legally able to enter into a contract, and accept these terms.
Gustamo prepares and delivers ready-made home-style food. Product availability, delivery areas, and available delivery times are shown during the ordering process and may change from week to week.
2. Orders and contract formation
- Product photos are illustrative. Presentation may vary because meals are prepared in batches and use seasonal ingredients.
- Please check your cart and delivery details before submitting your order.
- Submitting an order is an offer to purchase. A contract is formed when Gustamo confirms the order by phone or another contact method provided during checkout.
- We may refuse or cancel an order before confirmation if a product is unavailable, delivery is not possible, pricing is clearly incorrect, or we reasonably suspect misuse.
3. Prices and payment
Prices are shown in Polish złoty (PLN) and include applicable taxes unless stated otherwise. The delivery charge, if any, is shown before the order is confirmed. The total displayed at checkout is the amount due for the products; where the site states that delivery is calculated separately, Gustamo will confirm that charge before accepting the order.
The currently available payment method is cash on delivery. Please have the confirmed amount available when your order arrives. We may add or remove payment methods in the future.
4. Delivery
We deliver to the address you provide within the service area confirmed for your order. Delivery times are estimates and can be affected by traffic, weather, demand, or events outside our reasonable control. We will try to notify you of a significant delay.
You are responsible for providing a complete address, a working phone number, and reasonable access for delivery. If we cannot reach you or safely complete delivery, we may treat the order as cancelled and charge reasonable costs already incurred.
Please inspect the delivery promptly and refrigerate chilled meals without delay, following the storage information provided with each product.
5. Food information and allergens
Ingredients and nutritional values shown on the website are provided as practical guidance and may change. If you have an allergy, intolerance, or other dietary requirement, contact us before ordering. Our kitchen may handle common allergens, so we cannot guarantee the complete absence of traces or cross-contact unless we expressly confirm this for a specific product.
Follow all storage, reheating, use-by, and portion instructions supplied with your meals. Do not consume food if packaging is damaged, the product has not been stored correctly, or you reasonably believe it is unsafe.
6. Changes, cancellation, and withdrawal
Contact us as soon as possible if you need to change or cancel an order. We may accept a change only before preparation or dispatch has begun.
Because Gustamo meals are perishable goods and may be prepared for a specific delivery, the statutory 14-day withdrawal right generally does not apply after an order has been accepted. This does not limit your rights if products are faulty, damaged, unsafe, or not as ordered.
7. Problems and complaints
If something is wrong with your order, contact us promptly through the website chat and include your order number, a description of the issue, and photos where helpful. Keep the affected product and packaging until we respond when it is safe to do so.
Depending on the circumstances and your statutory rights, we may replace the product, issue an appropriate refund, or offer another suitable remedy. Nothing in these terms limits mandatory consumer rights under applicable law.
8. Our responsibility
We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care. We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or defective products.
We are not responsible for business losses, or for delays and failures caused by events outside our reasonable control. These products and this website are intended for personal, non-commercial use.
9. Acceptable website use
All website content, branding, design, and original materials belong to Gustamo or its licensors. You may view and use the website for personal ordering purposes. You must not disrupt the service, attempt unauthorized access, scrape it at scale, misuse checkout, or copy and commercially exploit its content without permission.
We aim to keep the website available and accurate, but we do not promise uninterrupted access. We may update, suspend, or withdraw parts of the site when reasonably necessary.
10. Governing law and disputes
These terms are governed by Polish law. If you are a consumer living elsewhere in the European Union, you also retain any mandatory protections available under the law of your country of residence.
Please contact us first so we can try to resolve a dispute informally. You may also use any consumer dispute-resolution process or court available to you under applicable law.
